The project documents, specifications, and architectural drawings (the Bidding Documents) may be obtained from the Design Professional: MT Studio Architecture, P.C., M. Tarver Siebert, 182 Elizabeth Street NE, Atlanta, Georgia 30307; 404-274-5900; tarver@mts-architecture.com. Documents will be distributed electronically, and only plan holders of record will receive addenda.
This project is funded in part by the Appalachian Regional Commission, administered through the Georgia Mountains Regional Commission, with matching funds from Fox Gives (Fox Theatre). Compliance with all applicable Federal, State, and Local Laws, Codes, and Standards is required of all contractors and subcontractors, including but not limited to the requirements described below. A bid bond in an amount not less than five percent (5%) of the total bid, including all additive alternates, will be required for this project. The successful bidder will be required to furnish a Performance Bond and a Payment Bond, each in the amount of one hundred percent (100%) of the Contract Sum.
Scope of Work
The Hart County Community Theatre is undergoing renovation. The Work generally includes the lobby (re-working the ticket booth and display windows and lighting), the concessions area (relocation, with new walls, ADA transaction counter, service table, and outlets), the theatre (removal of existing seating, refinished flooring, and installation of owner-supplied seating), the balcony (new terraced seating with owner-supplied seating), and the technical booth (a new sound booth with sliding windows, a built-in desk, and outlets).
Working Theatre — Schedule Considerations
The Hart County Community Theatre is an active, operating venue with an ongoing schedule of performances, rentals, rehearsals, and community events. The Theatre Use Schedule is included in Section 01 0500 of the Project Manual. Bidders should account for this in their approach and pricing.
The Owner anticipates issuing the Proceed Order on January 5, 2027. Each bidder will state on the Bid Form the number of calendar days required to achieve Material Completion (not more than 209 calendar days after the Proceed Order). Final Completion is required no later than September 1, 2027.
Contractors selected for this project should expect to:
- Coordinate all work and material deliveries around the Theatre Use Schedule in Section 01 0500 of the Project Manual;
- Maintain flexibility to phase work, including evening, weekend, or dark-period (non-performance) scheduling, to minimize disruption to programming;
- Provide advance notice to the Theatre Representative of any activity that would restrict entry, lobby, or restroom access, and coordinate temporary shutdowns of affected areas in advance;
- Secure and store tools, materials, and equipment in a manner that allows the venue to remain safely usable between work sessions, where required by the schedule.
Bidders shall account for all Theatre Unavailable and Restricted periods in the Theatre Use Schedule when stating the Material Completion time on the Bid Form. The stated time will not be used to determine the low bidder; the Contract will be awarded on price.
Mandatory Pre-Bid Conference and Site Visit
A pre-bid conference and site visit is MANDATORY: on Tuesday, October 13, 2026 at 10:30 a.m. at the Hart County Community Theatre, 83 Depot St, Hartwell, GA 30643. A representative of every prime bidder must attend and sign the attendance roster; bids will not be accepted from firms not recorded as attending.
Bidder Questions
All bidder questions shall be directed to Tarver Siebert, architect, MT Studio in writing by email to tarver@mts-architecture.com and cc Jason Ford at jason.ford@hartwellga.gov. Questions shall be received by Friday, October 16, 2026 at 10:30 a.m. and answers to all questions will be provided to all bidders by Thursday, October 22, 2026.
General Conditions
Bids may not be withdrawn for sixty (60) days after the bid opening, except as allowed by law. Bids will be publicly opened and read aloud at the time and place stated above; late bids, and electronic or faxed bids, will not be accepted. The Contract will be a lump-sum contract awarded to the lowest responsive and responsible bidder, and the Owner reserves the right to reject any or all bids for sound documented reasons and to waive technicalities and informalities. Bidders must hold a valid Georgia General Contractor license and comply with the Georgia Security and Immigration Compliance Act (E-Verify). Minority-owned firms, women’s business enterprises, and labor surplus area firms are encouraged to submit bids.
Federal Compliance Requirements
Because this project involves federal funding, bidders and their subcontractors must comply with the following requirements, in addition to all other applicable Federal, State, and Local laws, codes, and standards:
- Build America, Buy America Act (BABA): All iron, steel, manufactured products, and construction materials incorporated into the project must be produced in the United States, in accordance with the Build America, Buy America Act and its implementing guidance, unless a waiver has been granted by the applicable federal awarding agency. Bidders must be prepared to certify domestic sourcing of covered materials and to identify any items for which a waiver is being requested.
- Davis-Bacon and Related Acts: Contractors and subcontractors must pay laborers and mechanics employed on the project not less than the prevailing wage rates and fringe benefits determined by the U.S. Department of Labor for this locality and classification of work. Contractors must submit weekly certified payroll records, post the applicable wage determination at the job site, and flow down Davis-Bacon labor standards provisions to all subcontractors of every tier.
- Equal Employment Opportunity, Americans with Disabilities Act (ADA), and other applicable federal civil rights and labor requirements, as incorporated by reference in the drawings and specifications.
Bidders are responsible for reviewing the complete federal clauses and certifications included in the Project Manual (Section 00 7300) and drawings and for flowing down all applicable requirements to subcontractors of every tier.
Section 3 Covered Contract
This project is covered under the requirements of Section 3 of the HUD Act of 1968. This contract opportunity is a Section 3 Covered Contract. Section 3 Business Concerns are encouraged to apply. Section 3 documents are required prior to Notice of Award. The work to be performed under this contract is subject to the requirements of Section 3 of the Housing and Urban Development Act of 1968, as amended, 12 U.S.C. 1701 u (Section 3). The purpose of Section 3 is to ensure that employment and other economic opportunities generated by HUD assistance or HUD-assisted projects covered by Section 3, shall to greatest extent feasible, be directed to Section 3 residents and businesses in the area especially low- and very-low income persons, particularly persons who are recipients of HUD assistance for housing. Neither the United States nor any of the departments, agencies, or employees is or will be a party of any contract awarded pursuant to this invitation to bid.

This project is federally funded. Compliance with all applicable Federal, State, and Local Laws, Codes, and Standards, including BABA, Davis-Bacon, and Section 3, is required of all contractors and subcontractors. A bid bond of not less than five percent (5%) of the total bid will be required for this project, and the successful bidder must furnish 100% Performance and Payment Bonds.
The theatre remains active during construction; bidders should plan for flexible, phased scheduling around performances and events. Final Completion is required no later than September 1, 2027.
